A Las Vegas entertainer has initiated legal action against global superstar Taylor Swift, claiming that the title of Swift’s recent album infringes upon an existing trademark. The lawsuit centers on the title 'The Life of a Showgirl,' which the performer alleges violates her established intellectual property rights.
Trademark Dispute Filed in Federal Court
The complaint was officially lodged in federal court on Monday by Maren Wade, a performer based in Las Vegas. Wade asserts that Swift adopted the album title despite being aware of its similarity to Wade's long-running column, 'Confessions of a Showgirl.'
Origins of Wade's Intellectual Property
Wade’s column, which detailed anecdotes from her career in the entertainment industry, first appeared in Las Vegas Weekly back in 2014. Following the column's success, Wade adapted the material into both a live stage show and a published book, both using the same title.
In 2015, Wade secured a registered trademark for 'Confessions of a Showgirl' from the U.S. Patent and Trademark Office. The lawsuit notes that this trademark later achieved 'incontestable' status, confirming Wade's exclusive usage rights due to consistent application over several years.
USPTO Denial and Alleged Infringement
The legal filing indicates that when Taylor Swift’s team subsequently sought to register a trademark for 'The Life of a Showgirl,' the application was rejected. The denial allegedly occurred because the USPTO found the title to be 'confusingly similar' to Wade’s pre-existing mark.
Despite this ruling, Swift’s team allegedly proceeded with the title’s use. The lawsuit states that Swift’s team expanded the title across a coordinated commercial program and distributed it through retail channels reaching millions of consumers. Furthermore, the complaint emphasizes that Wade 'was never contacted' regarding the naming decision.
Impact on Wade's Brand Identity
Wade contends that the use of Swift’s album title has severely undermined her personal brand, which she has spent over a decade cultivating. The lawsuit argues that the titles share an 'immediate' similarity, noting they possess the same structure, the same dominant phrase, and the same overall commercial impression.
The filing further specifies that both brands operate in overlapping markets and target the same consumer base. The suit highlights the disparity in stakes, arguing that while Swift's success is vast, 'Confessions of a Showgirl' is Wade's only trademark and the foundation of her professional identity.
Legal Claims and Sought Remedies
In addition to trademark infringement, the suit names Swift and UMG Recordings for unfair competition. It also cites false designation, a legal prohibition against misrepresenting the origin of goods or services in commerce. UMG Recordings is noted as a branch of Universal Music Group, Swift’s label, and Bravado International Group Merchandising Services, Inc., another UMG branch, was also named.
Wade is seeking unspecified monetary damages to compensate for the 'irreparable harm to her business, reputation, and goodwill.' She is also requesting a court injunction to stop Swift from further utilizing the disputed album title.
