Justice Brett Kavanaugh questioned the relevance of comparing U.S. policy to that of other countries, stating, “I guess I’m not seeing the relevance as a legal, constitutional interpretive matter.”
ACLU’s Warning
The American Civil Liberties Union (ACLU) cautioned the court about the potential consequences of ruling in favor of the executive order. Cecillia Wang, the ACLU’s national legal director, warned the justices that “Thousands of American babies will immediately lose their citizenship. And if you credit the Government’s theory, the citizenship of millions of American citizens, past present and future, will be called into question.”
