A Software Engineer’s Ordeal

Alvi Choudhury, a 26-year-old software engineer, experienced a jarring encounter with the increasing use of artificial intelligence in law enforcement. He was arrested at his home in Southampton – 115 miles from Milton Keynes, a city he had never visited – due to a false positive identification by an AI facial recognition system.

The system incorrectly matched him to CCTV footage of a burglary at a Buddhist meditation centre in Bedfordshire, where £3,000 was stolen. Despite protesting discrepancies in age, facial hair, nose size, and lip shape, Choudhury was detained for ten hours before being released.

Other Cases of Misidentification

Choudhury’s case is not isolated. Rennea Nelson, a pregnant midwife, was wrongly accused of shoplifting in an Essex B&M store, causing a traumatic and stressful experience that jeopardized her high-risk pregnancy.

Similarly, anti-knife crime campaigner Shaun Thompson was stopped and questioned by police on Borough High Street in London. Facial recognition flagged him as a wanted individual, despite his lack of knowledge of any alleged wrongdoing.

Legal Challenge & Concerns Over Surveillance

Thompson, along with Silkie Carlo, challenged the Metropolitan Police’s use of live facial recognition in the High Court, arguing it violated their right to privacy under the European Convention on Human Rights. However, this challenge was unsuccessful.

The increasing reliance on facial recognition technology raises serious concerns about accuracy and potential bias, disproportionately impacting Black and Asian individuals who are more frequently identified as ‘false positives.’

How the Technology Works

These systems compare facial characteristics against vast databases of images, including mugshots and CCTV footage. The technology, provided by German firm Cognitech, processes approximately 25,000 comparisons monthly against a database containing 20 million images.

Privacy Advocates & Government Response

Critics argue that the indiscriminate scanning of faces in public spaces is akin to constant biometric surveillance, violating fundamental freedoms. Ruth Ehrlich, director of external relations for Liberty, emphasizes that live facial recognition is equivalent to having fingerprints scanned without consent.

The recent High Court ruling has been criticized by privacy advocates who fear wider deployment and increased misidentification. However, the government views the technology as a crucial tool in combating crime.

Policing Minister Sarah Jones announced plans for ‘record investment’ to roll the technology out nationwide, believing enhanced security contributes to public liberty.
