Trial Date Set for Accused UnitedHealthcare CEO Killer
The federal trial of Luigi Mangione, accused of murdering UnitedHealthcare CEO Brian Thompson, will now begin in October, a judge ruled on Wednesday. This represents a slight postponement from the originally scheduled September date, falling short of the defense’s request for a delay until the following year.
Scheduling Conflicts with State Trial
Judge Cites State Court Calendar
U.S. District Judge Margaret Garnett linked her decision to the scheduling of Mangione’s state trial, which is set to commence on June 8th and is expected to last four to six weeks. The defense had requested the federal case be postponed until January or February 2027, potentially allowing them to then delay the state case until September.
Judge Garnett rejected this proposal, stating that shifting the cases in that manner wouldn’t resolve the underlying issues of a compressed trial schedule. She argued it would simply move the problems from summer to fall.
Revised Court Schedule
Jury selection in the federal case will now begin on October 5th, instead of September 8th. Opening statements and witness testimony are rescheduled for October 26th, rather than October 13th. The judge noted that this schedule remains subject to change depending on the progress of the state trial.
Defendant Pleads Not Guilty
Luigi Mangione, 27, has pleaded not guilty to all charges. He faces a potential sentence of life in prison if convicted in either case. During a hearing in Manhattan federal court, Judge Garnett stated, “There’s really no way to avoid taking into account what’s going on in the state case.”
Concerns Over Double Jeopardy
Defense Argues for Fair Trial
Mangione’s lawyers had argued that consecutive trials on a tight schedule would violate his constitutional rights. In a February court appearance, Mangione himself stated, “It’s the same trial twice. One plus one is two. Double jeopardy by any definition of common sense.”
The judge acknowledged concerns about the state trial potentially impacting the federal case, particularly regarding double jeopardy protections, which can be triggered if a jury has already been sworn in a prior proceeding or if that proceeding results in a guilty plea.
The Crime and Arrest
CEO Brian Thompson Fatally Shot
Brian Thompson, 50, was fatally shot on December 4, 2024, while walking to a hotel in Midtown Manhattan for the UnitedHealth Group annual investor conference. Surveillance footage showed a masked gunman shooting him in the back.
Police found the words “deny,” “delay,” and “depose” written on the bullets used, seemingly referencing a tactic used by insurers to avoid paying claims. Mangione, a graduate of the University of Pennsylvania and from a wealthy Maryland family, was arrested five days later in Altoona, Pennsylvania.
Previous Legal Rulings
In January, Judge Garnett dismissed a federal murder charge that would have allowed prosecutors to seek the death penalty, citing legal defects. She also dismissed a related weapons charge but upheld charges of stalking, which carry a maximum sentence of life in prison.
