On Wednesday, Fox News Channel’s “Ingraham Angle” featured legal analyst Jonathan Turley discussing a case before the Supreme Court concerning birthright citizenship. Turley, a professor at George Washington University Law School, offered his analysis of the arguments presented.
Turley’s Observation: A Shift in Approach
Turley described the proceedings as “hilarious,” explaining that the liberal justices appeared to be adopting a methodology similar to that of the late Justice Antonin Scalia. He noted that these justices “rarely allow the language of the Constitution to stand in the way of a preferred interpretation.”
Focus on Original Intent and Precedent
According to Turley, the liberal justices were “channeling Scalia” by emphasizing original intent and the historical English rule regarding citizenship. He stated they were grappling with over 100 years of established legal precedent during the hearing.
A Benefit for the Left?
Turley further explained that this approach benefited the left in this particular case. Conservatives, he said, “tend to run home to this place, they tend to follow the precedent, they tend not to read too much into the language.”
