Despite the SCOTUS ruling impacting numerous states with similar legislation, Equality Utah believes Utah's current law is likely to remain intact. This confidence stems from the unique way Utah structured its legislation in 2023.
Equality Utah policy director Marina Lowe explained that Utah deliberately avoided copying the language used in the now-invalidated Colorado statute. Instead, the group collaborated with the Republican-supermajority Utah State Legislature to create an alternative framework.
A 'Viewpoint Neutral' Framework for Protection
Lowe stated that Utah's law was designed to strike a balance. It sought to protect minors from harmful and discredited medical practices while respecting the free speech rights of licensed therapists.
This specific Utah legislation passed unanimously through the legislature and was subsequently signed by the Governor in 2023. Lowe noted that this 'viewpoint-neutral framework' positions Utah well to withstand legal scrutiny following the Supreme Court's decision.
