The Senate recently passed a bill that would fund nearly all of DHS through the end of the fiscal year, excluding funding for immigration enforcement operations. Bedford explained that this approach is “controversial” for Democrats, who are seeking “a bunch of reforms” to immigration enforcement policies.

House leadership, under Speaker Johnson, has voiced concerns about the Senate’s commitment to addressing the more contentious aspects of DHS funding. Johnson stated the House will not pass the Senate version of the bill, preferring to fund all of DHS simultaneously.

Reconciliation Process Gains Traction

The House initially allowed Speaker Johnson and Senator Thune to debate the appropriate funding process before backing a plan utilizing the reconciliation process. Bedford noted that former President Trump’s “full backing” of this approach “finally broke the log jam.”

Republicans intend to use the two-track process, followed by reconciliation to overcome the 60-vote filibuster threshold needed to fund DHS. They have only one opportunity to use reconciliation annually, and Trump has expressed interest in incorporating “usable elements of the SAVE Act” into the legislation.

As the shutdown persists, White House Press Secretary Karoline Leavitt has urged lawmakers to “come back to Washington to permanently fix this problem.” Bedford indicated that Speaker Johnson will be expected to fulfill his commitment to bring lawmakers back to address the DHS funding issue.
