Criticism of Republican-Appointed Justices
During his post, Trump specifically named Justices Neil Gorsuch and Amy Coney Barrett, declaring that the Court would be ruling against him regarding birthright citizenship. He further accused all justices nominated by Republican presidents of "going out of their way to oppose me" as a way to demonstrate their independence.
Legal and Logistical Challenges
Trump signed the executive order on his first day back in office following his reelection. However, the order has faced significant opposition from critics who argue it violates the 14th Amendment and legal precedents dating back to the 19th century, which establish that those born on American soil are U.S. citizens with very narrow exceptions.
During oral arguments, several justices voiced concerns regarding the legal foundation of the Trump administration’s arguments. Additionally, other justices raised questions concerning the logistical challenges of implementing the order.
