A federal judge has rejected a motion to dismiss evidence against former Oakland Mayor Sheng Thao and her three co-defendants. The ruling pertains to a high-profile case alleging corruption, conspiracy, bribery, and fraud.
Judge Denies Dismissal Motion
Judge Yvonne Gonzalez Rogers determined that the defendants – Thao, her romantic partner Andre Jones, and recycling executives David and Andy Duong – failed to demonstrate misconduct by law enforcement. The decision, reported by the East Bay Times, found the evidence presented by the defense was not credible.
Allegations of a Bribery Scheme
The case centers around accusations that the defendants conspired to secure city contracts in exchange for political favors. Prosecutors allege that David and Andy Duong, owners of California Waste Solutions, provided financial support to Thao’s 2022 mayoral campaign and paid Jones through a no-show job.
In return, Thao allegedly promised to extend the Duongs’ recycling contract and commit the city to purchasing shipping containers from their company for homeless housing. The indictment, filed in January 2025, includes eight counts, including conspiracy, bribery, mail fraud, and making false statements.
Key Witness Cooperation
Mario Juarez, a longtime Oakland businessman, began cooperating with the FBI in 2024, prior to raids on the defendants’ homes. Juarez’s name was formally revealed in Monday’s court filings.
Defense Claims and Judge's Ruling
The defendants argued that the FBI omitted details about Juarez’s past business dealings when securing search warrants. However, Judge Rogers stated that the affidavits included relevant information regarding Juarez’s credibility and provided context for his statements.
All four defendants have pleaded not guilty and are scheduled to stand trial on October 19th. The case has garnered significant attention due to its potential impact on Oakland’s local politics and public contracting processes.
