Ben Pasternak, the entrepreneur behind vegan meat company Simulate, has been arrested and charged with assaulting his girlfriend, Evelyn Ha, a social media influencer. The alleged incident occurred last month at the Baccarat Hotel in New York City.
Allegations and Charges
According to a criminal complaint, Pasternak, 26, is accused of strangling Ha, 27, and repeatedly slamming a door on her. Ha reportedly suffered visible bruising and difficulty breathing, requiring medical attention. He faces charges of second-degree strangulation and assault with intent to cause physical injury, to which he has pleaded not guilty.
Conflicting Accounts
Both Pasternak and Ha have presented differing versions of events. Pasternak’s defense team claims Ha was the aggressor, alleging emotional and physical abuse, jealousy, and prior threats if he ended the relationship. Spokeswoman Dini von Mueffling asserts Ha is now acting on those threats with false accusations.

Evelyn Ha publicly stated she ended the relationship due to safety concerns, citing serious boundary violations and fear for her wellbeing. She confirmed she ended the relationship immediately after the alleged attack in a YouTube video.
Legal Proceedings and Defense
The case has garnered significant attention due to the prominence of both individuals. Pasternak was released on his own recognizance, despite a prosecution request for $30,000 bail. His lawyer, Josh Kirshner, maintains his client’s innocence, citing inconsistencies in Ha’s account and a lack of corroborating evidence.
Self-Defense Claim
Kirshner states Pasternak acted in self-defense and attempted to disengage from the situation. Von Mueffling alleges a history of physical attacks by Ha against Pasternak. The incident reportedly escalated when Ha attempted to film Pasternak inside the hotel room.
Ha reported experiencing redness to her neck, throat pain, and breathing difficulties, as well as bruising to her arms and hips. The legal battle is ongoing as the conflicting narratives continue to fuel public interest.
